BOOKING TERMS AND CONDITIONS

IMPORTANT NOTICE TO ALL GUESTS

PLEASE READ THESE TERMS CAREFULLY BEFORE MAKING ANY PAYMENT OR CONFIRMING YOUR BOOKING.

Travel Unbounded World Pvt Ltd receives tour payments directly into its company bank accounts as part of a centralised booking, collection and settlement process.

Receipt of payment by Travel Unbounded does not mean that Travel Unbounded owns, operates, manages or directly provides every hotel, airline, vehicle, cruise, activity, guide, safari, transfer or other service included in the itinerary.

Travel Unbounded acts as the tour organiser, travel planner and booking coordinator. Individual travel components are operated and delivered by independent third-party service providers.

Travel Unbounded World Pvt Ltd shall not be responsible for any death, accident, injury, illness, loss or damage caused by the acts, omissions, negligence, equipment, vehicles, premises, employees, contractors or operational failures of an independent third-party service provider, or by circumstances beyond Travel Unbounded's reasonable control.

Nothing in these Terms excludes any responsibility that Travel Unbounded cannot lawfully exclude, including responsibility arising directly from Travel Unbounded's own fraud, wilful misconduct, material misrepresentation or breach of a statutory obligation.

1. Definitions

For the purpose of these Terms and Conditions:

“Travel Unbounded”, “TU”, “we”, “us” or “our” means Travel Unbounded World Pvt Ltd.

“Guest”, “traveller”, “customer”, “you” or “your” means the person making the booking and every person travelling under that booking.

“Tour” means the complete itinerary, holiday, package, journey or travel arrangement booked through Travel Unbounded.

“Third-Party Service Provider” or “Supplier” includes airlines, hotels, resorts, villas, transport operators, drivers, destination management companies, guides, cruise companies, railway operators, activity providers, safari operators, restaurants, insurance companies and other independent suppliers.

“Lead Guest” means the person who communicates with Travel Unbounded, confirms the booking or makes payment on behalf of the travelling group.

2. Acceptance of Terms

By making any payment, confirming a booking, approving an itinerary or travelling under a booking arranged by Travel Unbounded, the guest confirms that:

  • These Terms and Conditions have been read and understood.
  • These Terms are accepted on behalf of every person included in the booking.
  • The Lead Guest has authority to accept these Terms for all travellers included in the booking.
  • All travellers have been informed of the risks, restrictions and supplier conditions applicable to the tour.

These Terms shall apply whether the booking is confirmed through email, WhatsApp, telephone, website, payment link, bank transfer or any other method.

3. CRITICAL CLAUSE: TRAVEL UNBOUNDED'S ROLE

Travel Unbounded is responsible for designing, planning, recommending, booking and coordinating the travel arrangements specifically agreed with the guest.

However, Travel Unbounded does not ordinarily own or directly operate the underlying travel infrastructure or services, including:

  • Aircraft or airlines
  • Hotels, resorts, villas or camps
  • Cars, coaches, buses, boats or trains
  • Safari vehicles
  • Adventure or water-sport facilities
  • Cruise vessels
  • Restaurants
  • Tourist attractions
  • Hospitals or medical facilities
  • Destination-based ground services

These services are operated by independent third-party suppliers under their own licences, management, employees, safety systems, equipment and operational control.

The inclusion of a supplier in an itinerary does not create an employer-employee, partnership, joint venture or ownership relationship between Travel Unbounded and that supplier.

4. CRITICAL CLAUSE: DIRECT RECEIPT OF PAYMENT

4.1 Centralised collection

For the convenience of guests and suppliers, Travel Unbounded may collect the entire tour amount directly into its company bank account.

The amount collected may include:

  • Travel Unbounded's planning, booking, coordination or service charges.
  • Amounts payable to hotels, airlines, transporters, destination companies and other suppliers.
  • Taxes, statutory charges and payment-processing costs.
  • Foreign exchange differences, bank charges and remittance expenses.
  • Other costs relating to the confirmed itinerary.

4.2 Payment does not establish operational ownership

The fact that payment is made directly to Travel Unbounded, and that Travel Unbounded issues a payment receipt, confirmation, voucher or invoice, shall not by itself mean that Travel Unbounded is the owner, operator, carrier, hotelier, transporter, driver, guide or activity provider.

Travel Unbounded collects and administers the booking amount as the tour organiser and coordinating entity. The actual performance of each travel component remains the responsibility of the supplier operating that component.

4.3 Payments made to suppliers

Travel Unbounded may remit booking amounts to suppliers in advance to secure rooms, flights, vehicles, activities or other services.

Once an amount has been committed or paid to a supplier, its refund, cancellation and amendment treatment may be governed by that supplier's terms.

Travel Unbounded cannot guarantee a refund from a supplier where:

  • The supplier's booking is non-refundable.
  • The cancellation falls within the supplier's penalty period.
  • The supplier has already incurred or committed expenses.
  • The service was available but was not used by the guest.
  • The supplier refuses or delays the refund.
  • The cancellation resulted from circumstances beyond Travel Unbounded's reasonable control.

Where a supplier approves and pays a refund to Travel Unbounded, the refundable amount shall be remitted to the guest after deducting applicable cancellation charges, taxes, bank charges, foreign exchange losses and non-refundable service charges.

4.4 No assumption of supplier liability

Collection of money by Travel Unbounded shall not amount to Travel Unbounded assuming responsibility for:

  • The maintenance of a supplier's property or equipment.
  • The recruitment, training or conduct of a supplier's employees.
  • The roadworthiness of vehicles.
  • The airworthiness or operation of aircraft.
  • Food preparation or hygiene at third-party premises.
  • Security arrangements at hotels, camps or attractions.
  • Safety systems used by activity providers.
  • Medical treatment provided by hospitals or doctors.
  • Operational decisions made by airlines, hotels or local authorities.

5. THIRD-PARTY SERVICE PROVIDERS

Each supplier may have its own:

  • Booking terms
  • Cancellation policies
  • Check-in requirements
  • Baggage rules
  • Safety instructions
  • Age, height, weight or fitness restrictions
  • Liability limitations
  • Governing laws
  • Refund procedures

Travel Unbounded may provide reasonable assistance in communicating with a supplier. Such assistance shall not amount to an admission that Travel Unbounded is responsible for the supplier's acts or omissions.

6. LIMITATION OF RESPONSIBILITY FOR THIRD-PARTY SERVICES

Nothing in this clause excludes responsibility that arises directly from Travel Unbounded's own act or omission where such responsibility cannot lawfully be excluded.

8. TRAVEL UNBOUNDED'S OWN RESPONSIBILITIES

Travel Unbounded shall remain responsible for carrying out its own agreed booking and coordination obligations with reasonable care.
